Following a public inquiry in 2004 permission was granted in 2006 for the reclamation of Bathside Bay and development to provide an operational container port comprising a series of works. Consent for the making of a harbour revision order was also granted in 2006 to authorise works below the low watermark.
The extant permissions allows for:
The reclamation of 74.55 hectares of Bathside Bay and development to provide an operational container port, comprising:
- 1400m of quay wall;
- 11 quayside cranes;
- 44 RTGs; and,
- 6.13 ha rail terminal with 3 RMGs.
Construction of a Small Boat Harbour to provide sheltered moorings for boats, slipway and boat storage, public viewing and seating areas, Fishermen’s stores and fuel facility.
Construction and the breaching of the sea wall to create compensatory habitat comprising 117ha of estuarine and coastal habitat at Hamford Water.
Works to Listed Train Ferry Gantry that includes the partial demolition of the long berthing arm and associated remedial works.
The dredge of 8.0 million m3 of material from the bed of the River Stour to form a 14.5m deep channel accessed from the existing 14.5m channel to the Port of Felixstowe.
In February 2010 HPUK made two new applications to Tendring District Council:
| i) | A section 73 application to vary the conditions attached to the 2006 Permission relating to the provision of the A120(T) improvements amending them so that they are delivered when the container terminal becomes operational;

| ii) | An application for a replacement permission subject to a new time limit to expire 2021. |
